Registered User Terms
Rules of the TotalTennis Community
In return for the LTA allowing you to become a registered user of the
TotalTennis Community ("the Community") you hereby agree to the following rules
which shall govern your use of this website and any other website that is part
of the Community ("the Site"):
- Subject to what is said below material from the Site may be downloaded,
viewed, listened to (where appropriate), printed, copied on the hard disk of
your computer (but not photocopied) and used for your own personal,
non-commercial purposes as a personal information resource in good faith ONLY.
Any other type of use requires the prior written agreement of the LTA.
- You agree not to use the Site or your membership of the Community:
- (a) for submission to the Site, the LTA or to any other members of the
Community of any material, the publication, dissemination, use or possession of
which infringes the rights of any person or which is unlawful in any other
respect;
- (b) for the submission to the Site, the LTA or to any other members of the
Community of any unsolicited or unauthorised advertising, promotional materials,
"junk mail," "spam," "chain letters," "pyramid schemes," or any other form of
solicitation or commercial exploitation;
- (c) for the submission to the Site, the LTA or to any other members of the
Community of any material that contains software viruses or any other computer
code, files or programs designed to interrupt, restrict, destroy, limit the
functionality of or compromise the integrity of any computer software or
hardware or telecommunications equipment;
- (d) to create a database (electronic or otherwise) that includes material
downloaded or otherwise obtained from the Site except where expressly permitted
on the Site;
- (e) to transmit or re-circulate any material obtained from the Site to any
third party except where expressly permitted on the Site;
- (f) in such a way so as to remove the copyright or trade mark notice(s) from
any copies of any material made in accordance with these terms; or
- (g) in any way that might bring the LTA, any County Lawn Tennis Association
or tennis club/centre affiliated to the LTA or the game of tennis into disrepute.
- You grant the LTA and/or its authorised administrator a non-exclusive,
royalty-free, perpetual and worldwide licence to use and publish any material
you submit to them or to the Site in any form, including without limitation
print and electronic form. The use of any material containing personal data is
governed by: The Data Protection Act 1998 and the Total Tennis privacy
policy
- You waive all of the moral rights that you have under Chapter IV of the of
the Copyright, Design and Patents Act 1988 in respect of any material you submit
to the LTA, the authorised administrator or to the Site.
- You confirm that you are at least 18 years of age, or, if under 18, that
you are accessing the Site with full parental/guardian consent.
- The LTA and/or the authorised administrator shall have the right to refuse
to allow you access to any part of the Site or to cancel your membership of the
Community at any time and for any reason without giving you any advance notice
and neither the LTA nor the authorised administrator shall be liable for any
losses or damages whatsoever arising from your inability to access or use any
part of Site or your membership of the Community.
- The LTA and/or the authorised administrator shall have the right at any
time and for any reason to alter or remove from the Site any material submitted
by you without giving you any advance notice and neither the LTA nor the
authorised administrator shall be liable for any losses or damages whatsoever
arising from the alteration or removal of such material.
- The copyright, and other rights, the material appearing on or in the Site
belongs to the LTA or to third parties. You may not (save as allowed in these
terms and conditions) copy, reproduce, transmit or distribute any such material
without the licence or permission of the author and you agree to pay any costs
or expenses incurred by the LTA and the authorised administrator which may arise
as a result of your failure to obtain such licence or permission.
- Some of the pages of the Site may contain chat pages, bulletin boards or
other forums in which users are able to post material for viewing by others. The
LTA does not edit or monitor the content of these pages and, subject to what is
said below, does not have any knowledge of any of the activities or information
carried on in, or contained within, those pages. If anyone becomes aware that
any material on those pages, or any activities carried out on those pages, are
offensive, unlawful or infringe any third party rights in any way, please send
an appropriately worded message to the LTA by clicking here.
The LTA shall then act expeditiously to remove any such material or to disable
access to the information.
- Whilst every effort has been taken to ensure the accuracy of the
information contained on the Site, it has been provided from a number of sources
and neither the LTA nor the authorised administrator accept any liability for
this information. It is the responsibility of users to check the accuracy of
relevant facts and opinions given on the site before entering into any
commitment based upon them.
- Neither the LTA nor the authorised administrator can guarantee that your
use of the Site will be free from error and/or uninterrupted. Neither the LTA
nor the authorised administrator shall be liable for any damages including, but
not limited to, indirect or consequential damages, damages for loss of
opportunity or chance, or any damages whatsoever arising from use or loss of
use, data, or profits, whether in contract, negligence or other tortious action,
arising out of, or in connection with the Site or any other Internet sites.
- The Site may contain material (including, but not limited to,
advertisements) posted by third parties. Individual users and advertisers are
solely responsible for the content of advertising and other material which they
submit to the LTA and/or the authorised administrator and for ensuring that such
content complies with all relevant legislation. The LTA accepts no
responsibility for the content of material submitted by third parties,
including, without limitation, any error, omission or inaccuracy therein.
- Save unless otherwise stated, no warranty whatsoever is given as to any
goods or services purchased, obtained or offered to you through use of the Site,
whether accessed directly or otherwise, and no liability is accepted by either
the LTA or the authorised administrator in relation to any contract entered into
by you with any third party on or by means of the Site.
- The Site may contain links to external websites. These links are included
to give users the opportunity to access other pages that it is felt may be of
assistance to them. Neither the LTA nor the authorised administrator is
responsible for the content of these Internet sites.
- Whilst effort has been taken to ensure that the Site is free from
viruses, no warranties are given that it is free from viruses and users are
responsible for ensuring that they have installed adequate virus checking
software. Neither the LTA nor the authorised administrator shall be liable for
any viruses or any other computer code, files or programs designed to interrupt,
restrict, destroy, limit the functionality of or compromise the integrity of the
Site or any hardware on which it is hosted.
- The names, images and logos identifying the LTA or third parties and
their products and services, are the proprietary marks of the LTA, and/or may be
the proprietary marks of third parties. Any use made of these marks may be an
infringement of rights in those marks and the LTA reserves all rights to enforce
such rights that it might have.
- Nothing in these terms serves to exclude or limit liability for death or
personal injury arising from negligence or any liability which is otherwise
prohibited from being excluded by law.
- These terms may be varied from time to time. Please ensure that you
review these terms regularly as you will be deemed to have accepted a variation
if you continue to use the Site after a variation has been posted.
- If any of these terms should be determined to be illegal, invalid or
otherwise unenforceable, it shall be severed and deleted from these terms and
the remaining terms shall survive, remain in full force and effect and continue
to be binding and enforceable.
- In these terms: (a) 'authorised administrator' means any person, firm,
company or unincorporated association which has been granted rights by the LTA
in respect of the Site; (b) 'submit' in relation to any content or material
includes send (whether by email or other means), transmit, upload and post; (c)
'terms' means these terms and conditions.
- As mentioned at Clause 8 above, the Site includes third party material
and since your use of that third party material is governed, in part, by these
terms, these terms may be enforced against you by any third party with an
interest in the said material, including, without limitation, any County, Club or Centre Lawn Tennis Associations.
- These terms shall be governed by and construed in accordance with the
laws of England and Wales. Any disputes arising from matters relating to the
Site shall be exclusively subject to the jurisdiction of the courts of England
and Wales.
